«Flags of convenience» in global fisheries: international legal aspects

Abstract

The concept and characteristics of a «flag of convenience», the history of the emergence and use of such flags in marine fishing are considered in the article. Statistics on the use of «flags of convenience» are provided, and international legal aspects of nationality and registration of sea vessels are explored. Special attention is paid to the analysis of the requirements regarding the existence of a genuine link between the State and the ship, established by international law. The negative consequences of the use of «flags of convenience» in marine fisheries have been noted, and proposals have been developed for the adoption of international legal measures aimed at preventing such negative results.
